Arc Pensions Law advises on the sale of Burton’s Biscuits to Ferrero

It was recently announced that a Ferrero-related company had entered into a definitive agreement to acquire Burton’s Biscuit Company from the Ontario Teachers’ Pension Plan.

Burton’s produces some of the best-loved brands in the UK biscuit market including Maryland Cookies, Jammie Dodgers, Wagon Wheels, Paterson’s and Thomas Fudge’s. The business has a history in the British biscuit market dating back to 1935, with a very strong heritage and brand awareness.

Ferrero is an Italian family-owned confectionery manufacturer perhaps best-known for its Ferrero Rocher chocolates. Its other global brands include hazelnut spread Nutella, and Tic Tac mints.

Arc Pensions Law advised on the pensions-related aspects of the sale, alongside the sellers’ corporate legal advisers Kirkland & Ellis.
