Anna Rogers comments in Pensions Expert on age discrimination in pension scheme transition arrangements
Several Employment Tribunal judgments in recent months have tackled questions of alleged age discrimination, most notably finding that transition arrangements for judges’ pensions were discriminatory.
However, Anna Rogers, Senior Partner, said it was unpredictable whether a legal case for discrimination could be made, commenting that a specific age-related condition might be justified if the employer has evidence of a sound aim and proportionate means designed to achieve it: “It’s not enough that it just has an impact on certain age groups.”
